Day 04 Mon. (10.09.2012) Day 1: Polglass Way, Ardross is 247km to Dunsborough driving south passing by Mandurah, Bunbury and Busselton

We started the day early and by 7.30am we were on the Kwinana Freeway/State Route 2 heading south to Mandurah a 63km away. At about 9am we visited Dave?s step grandfather, Alf Garden who is 84. He is still very healthy and has been cycling 40km at times. Alf Garden stays alone in a very cozy house nearby the sea in Mandurah.

At 10am Dave hired a 8 seater runabouts boat (A$50) from Blue Manna, 13 Dolphin Drive, Mandurah, (http://www.bluemannaboathire.com.au) for an hour boat drive along the man-made canal. Dave drove us through the scenic Peel Inlet and the Mandurah Estuary viewing the luxury canal side homes.

At 11am we had the best fish and chips for lunch at Cicerello, (http://www.cicerellos.com.au) no.73 Mandurah Terrace overlooking the beautiful Mandjar Bay.

At 12noon we continued another 160km road journey south passing by Bunbury and arriving at Busselton at 2.25pm on Forrest Hwy and Bussell Hwy. From here we continued 24km on Caves Rd. to Dunsborough arriving at 2.52pm to pick up the Pelican Cottage keys from Cape Executive Holiday Properties office at 4a Dunn Bay Centre, 31-33 Dunn Bay Rd. which was pre-booked online by Monica. The cottage was very clean and pleasant with all facilities available. The weblink: http://www.capeexec.com.au

After checking-in to the cottage, we headed out to explore the town and did some shopping for dinner at Coles supermarket. Dave went and bought some wine for the ladies from another bottle shop. Dinner was awfully fantastic; Dave prepared grilled salmon bought at Coles with plenty of wine to go with.

Baltimore - University Breaks Ground on Nursing Building




Notre Dame of Maryland University recently broke ground on a $15 million, 36,500-square-foot facility for its schools of nursing and education.

The new building will include clinical simulation labs to support its full-time undergraduate nursing program, which began last year, as well as its graduate nursing and RN-to-BSN programs.?The facility is designed to meet requirements for LEED certification.

Funding for the academic building is supported by a $4 million matching grant from the state. A $90,000 grant from the Marion and Henry J. Knott Foundation and a $125,000 grant from the Middendorf Foundation will support the installation of the clinical simulation labs. The project is expected to support more than 200 construction jobs and inject more than $11 million of private funding into the economy.

The nursing facilities are scheduled to be completed in time for the 2014 academic year.

The propaganda of Israel and weakness of America

If nuclear weaponry wasn?t such a threat to humanity, the rhetorical battle between Israel and Iran would be comical and laughable.

But nuclear weapons are a threat to all mankind, not just to the arrogant who believe they and they alone count on this planet that we call Earth.

The irony is that Israel has 250 armed nuclear warheads that can be fired at any time to destroy its Arab and Muslim neighbors, including Iran. Yet, it screams at every opportunity afforded it by the biased mainstream Western media attacking Iran and declaring that Israel will prevent Iran from developing nuclear technology.

Let?s get something straight in this hypocritical rhetorical battle of hyperbole and public relations spin: Only one country in the Middle East region has nuclear weapons and that is Israel. Not Iran. Not the Arab countries. Just Israel.

Israel provokes the region through offensive policies that affront civil rights and the rule of law. Israel?s fanatical leaders continue to proclaim they will destroy anyone who challenges their power, even if the challenge is to force Israel to be accountable for its war crimes committed since its founding in 1948.

Israel, not Iran, is the country that threatens the region. It has taken, and continues to take, lands owned by Arabs. Israel, not Iran, has killed civilians.

Israel is the country that continues to call for military strikes against another foreign country while Americans ignore justice, law and principle to mindlessly soak in the Israeli propaganda.

Iranian President Mahmoud Ahmadinejad does not represent the Arab or the Muslim world. Many argue he doesn?t run Iran?s government. But his indictment of Israel, burdened by extreme rhetoric and wild emotional invective, resonates among the Arabs and Muslims who have been bullied, oppressed and victimized by Israel.

America is much like a police officer who watches as a friend enters and robs a store. When the store owner screams for help, he is beaten by the police officer and the thief is allowed to flee.

When it comes to Israel, American justice is based on politics not the rule of law. American justice is blind to crimes against Arabs and Muslims.

Israel steals land from Arabs and America is silent. Israel murders Arab activists calling it ?extrajudicial killing,? an admission that the killings are illegal. Israel?s government conducts itself outside of the rule of law, and exploits American ignorance and its powerful PR spin and news media manipulation and influence to prevent challenge.

I?m not saying that Ahmadinejad is any better than Israel?s rightwing fanatic leadership, a leadership that has for the past four years refused to negotiate peace just so it can expand its illegal Jewish-only settlements in the occupied West Bank. But Ahmadinejad is no worse that Israeli Prime Minister Benjamin Netanyahu.

It wasn?t Ahmadinejad who sent armed soldiers to assault a flotilla of boats in 2010 driven by loud-mouthed but unarmed activists, many of whom hate Israel. But hatred isn?t a crime. Isn?t that what the West keeps telling Muslims? Hatred of Muslims in the anti-Muslim video is ?free speech.?

But hatred was enough for Israel to kill nine civilians, including one American citizen. Apparently the murder of an American who criticizes Israel is not murder. Furkan Dogan, an American living in Turkey, was murdered by Israeli soldiers on the flotilla when he resisted, without a weapon, the attacking Israeli soldiers.

Rachel Corrie was another American citizen who was killed by an Israeli soldier driving an American-made Caterpillar D-9 tractor. The Israeli soldier was destroying Arab civilian homes to make room for Israeli settlers in the Gaza Strip in 2003. The soldier knew protestors including Corrie were trying to stop the destruction and saw her. He ran her over.

Justice and Israel are antonyms, words opposite in meaning to each other.

And you can?t get justice in America either if you happen to be a critic of Israel.

I support two-states, compromise and peace. I support non-violence and I oppose violence. But I don?t support hypocrisy.

It is shameful to watch as President Barack Obama cowers under Israel?s PR onslaught, afraid to tell the American people the truth because it might cost him his re-election.

Obama?s actions are an admission that extremism is more powerful than truth!

Obama walked out of the United Nations because he didn?t want to hear criticism of Israel. Americans tolerate criticism of every other country in the world, including of some of the most oppressive regimes in the world like China. But criticize Israel and America won?t tolerate it at all.

We?ll even go to war for Israel, at the cost of American lives. We already give Israel billions of dollars in funds every year, money that could otherwise feed Americans who continue to starve on the streets of America.

But America won?t stand up to Israel. By refusing to stand up to Israel, America empowers megalomaniacs like Ahmadinejad who speak to the injustices caused by Israel, injustices no one else will address. American justice truly is blind.

Lauren Handel is back today with further insight into the possible legal objections to California?s Proposition 37, the popular referendum on mandatory GMO labeling of food products. Once again, she puts policy and science debates to the side and examines just how challenging it will be for Prop 37 to successfully navigate our constellation of existing food laws.?

In addition to the First Amendment challenges Prop 37 that we covered yesterday, the opponents of the measure will seek to invalidate the law on the grounds that it is preempted by federal food labeling requirements.? Preemption is the constitutional principle that federal law trumps state law.? State laws may not conflict with federal laws.? Specifically with regard to food labeling, the Food, Drug, and Cosmetic Act (?FDCA?), Federal Meat Inspection Act (?FMIA?) and the Poultry Products Inspection Act (?PPIA?) all contain provisions expressly stating that they preempt conflicting state laws.

Opponents of Prop 37 have a strong argument that the law would be preempted by FMIA and PPIA to the extent it would regulate the labeling of meat and poultry products.? That is because FMIA and PPIA prohibit state labeling requirements for meat and poultry products? ?in addition to, or different than? federal requirements.? Prop 37 would impose requirements ?in addition to [and] different? from federal requirements because it would require labeling of genetically-engineered meat or poultry products whereas no such requirement exists in federal law.? In addition, Prop 37 would impose different requirements in direct conflict with federal law in that it would prohibit ?natural? claims on minimally-processed meat and poultry products that would be permitted?and could even be pre-approved by USDA?under federal law.

In contrast, Prop 37?s requirements for labeling foods within the ambit of FDCA (nearly everything other than meat and poultry) probably are not preempted.? FDCA?s preemption language prohibits state labeling requirements that are ?not identical to? federal requirements.? In interpreting this provision, courts have held that states may impose labeling requirements addressing issues not regulated by FDA.? Because FDA has not regulated the use of ?natural? claims, many courts have held that states are free to do so.? The same analysis should apply to regulation of genetically-engineered food labels.? Because FDA policy does not require nor prohibit disclosures that foods are genetically engineered, Prop 37?s disclosure requirement (with respect to foods other than meat and poultry) should not be preempted.

Nevertheless, challengers may argue that Prop 37 is preempted because it would conflict with FDA ingredient labeling requirements.? A? recent decision of a federal court in California held that state requirements to disclose of genetically-engineered ingredients are preempted by FDA?s exhaustive regulation of ingredient listings.? That decision, however, does not apply to Prop 37 because Prop 37 would not require manufacturers to identify ingredients that were genetically engineered.? Rather, Prop 37 would require only a statement on the front or back of a package stating that a food is genetically engineered or has been produced with genetic engineering.

A somewhat better argument for preemption might be that, in requiring manufacturers to identify products as genetically engineered, Prop 37 would cause them to violate FDCA?s prohibition against making misleading claims.? The argument would be that a ?genetically-engineered? label would mislead consumers into believing that the food is materially different than (and inferior to) a comparable product containing traditional ingredients.? While this argument may have some appeal in light of FDA?s position that genetically-engineered foods are no different than their traditional counterparts, FDA has stated (albeit in a draft guidance document) that simple, factual statements of the type Prop 37 would require?that a food is genetically engineered or contains genetically-engineered ingredients?are not likely to be misleading.? Although FDA?s guidance on this issue would not be binding on a court, it is some evidence that the agency would not consider the disclosure claims required by Prop 37 to run afoul of FDCA?s prohibitions against misleading claims.

Exoma Energy announced that it has spudded Fittleworth?1, the eleventh well of the Galilee Joint Venture?s 2012 exploration program.

This well will be drilled using EDA Rig #1. The well will be a test of the Toolebuc shale.

The well is located in Galilee Basin, approximately 30km south of Longreach, Queensland and it s target is oil and gas in the Toolebuc shale.

The well will be cored through the Toolebuc shale section and the core will be subject to laboratory analysis. On completion of coring, the well will be deepened to provide depth control to local seismic data.

Exoma has a 50% beneficial interest in both ATP 1005P and the Fittleworth?1 well. CNOOC Galilee Gas Company Pty Ltd is earning its participating interest by a farm?in whereby CNOOC provides the first $50 million of joint venture expenditures on Exoma?s five Galilee Basin ATP?s.

SimpleTV clarifies shipping dates, tells backers units will start arriving October 10th

According to Simple.TV, there have been articles circulating around the interwebs that may have caused confusion amongst parties interested about the shipping dates of its facile white puck. So, in order to induce some clarity, the folks behind the project have posted a Kickstarter update to let its backers know their Simple.TVs will be arriving soon -- somewhere between October 10th and 15th, to be precise. On the other hand, Simple.TV is also set to start taking pre-orders on its website tomorrow from folks who missed out on the crowd-funded party, with these particular units estimated to ship "within 20 days" after the order has been placed. The good news is we're only a couple of weeks away from its long-overdue arrival; in the meantime, however, don't forget we have our own hands-on for you to graciously pore over.

Personal Injury Law: Plaintiff's Loop Hole in A Personal Injury Case

The victim of a personal injury will take extra effort to be reimbursed if not much at least equal to the pain and suffering he/she got in an accident. All perspectives should direct to the fact that he shouldn't be there if the defendant did his duty to care. Naturally, you would took pity on the victim. He/she suffered enough, will lose his/her salary, will have to spend on medication, may be disabled forever, and can even suffer emotional detachment from his/her family and other relatives.

In general, we seldom take into account the side of the defendant. The first thing that comes in to our mind is that it was their fault that the accident had happened. They are not ought to suffer physical damages nor psychological trauma. They will be free and can continue going on with their life. Whereas the victim shall be put on his bed for a long time.

Perhaps, these two perspectives are right in a circumstantial outlook. However, all blames may not be put in to the defendant's shoulder. Proper investigation shall be made before final judgment.

Personal injury lawyers do not took into consideration the reason why their clients are put in such dangerous condition. They don not emphasize on why their clients have to compensated. They don't put much stress on convincing the jury that plaintiff simply needs compensation to support medical needs. But lawyers put much emphasis on the issue that their client shouldn't be there if only the defendant was careful enough.

That's one primary concern in a personal injury lawsuit. Who had act on his/her duty to care/ Was it the defendant though he was not injured or the plaintiff who have been injured because of his own negligence. The participation of the plaintiff in an accident shall be weighed by the jury. The determined worth of participation shall then be deducted to the total compensation he/she can get.

Here are the loop holes that a plaintiff's lawyer must look into:

a. contributory negligence

it is a condition by which the plaintiff was the sole liable of his own accident. Contributory negligence is usually a counter argument for lawyers who act against insurance companies. When it is proven that the plaintiff was the one fault, he or she may get a little award and in worst extent he/she will gain nothing at all.

b. comparative negligence

it is a situation by which the plaintiff is only partially to be blame in the accident. This usually happens when the defendant also got in trouble and witnesses can testify that the victim didn't do his duty to care for himself and to other people. The worth of participation will be determined by the jury and will then deducted to the total compensation awarded.

c. failure to mitigate damages

it is an instance by which the victim didn't seek medication for the seen injured part of his/her body. The failure to do so may result to making the injury critical. In this case, the claim will only cover the expenses if the injury has been medicated earlier.

These three instances remind as that before going to sue and file a case you should know where to stand on and the claim you want is justifiable enough. In a blog from LedgerLaw.com, it may take years before a lawsuit can be resolved depending on the complexity of the case especially if the plaintiff made its contribution in the accident.

This is the thread where you introduce the ghostly ?servant? whom will come to serve your character throughout the roleplay, their profiles do not have to be so detailed as your primary characters, but I?d like them to have some felt depth to them. ^-^;; I?ll provide a basic skeleton to use in order to come up with your servants, but feel free to add to it if you want to, so long as you give the information in the default fields~

As for the history of our ?ghosts? here, well, they don?t have to have personal ones at the moment. The ghosts are souls who are bound to the house by choice, they came to be servants here of their own volition some ages ago. . . . Their role is to look after a single person, to offer to them comfort and advice, and to aid them in overcoming the problems which haunt them. As they take on the appearance of a face that holds some significance to the characters, their presence is a felt one. Their lives from before being bound to the house can be left ambiguous, unless you have some plans regarding that. The people they were before becoming bound to the house is entirely up to you?they can even be another gender than what they appear to be to the characters in reality.

They?re charmed to take on the appearance of a particular person, no matter the gender.

Personality: Celestine is a bit of an odd fellow?the life he led before becoming bound to the house is something he doesn?t much speak of, but his personality has not seemed to have changed much. He?s a rather joking sort, enjoying to poke fun at others until he gets a rise out of them. Even then, he?ll just laugh the outburst off. As far as he is concerned, he?s got nothing to really be afraid of, if someone tried to hit him, he could just phase through it. . . . So, really, he?s a jokester, someone who provokes others, seeming to not care really about what?s going on within a person?s head or heart, as he can really come off as an insensitive jerk. In truth though, Celestine is . . . deeper than that. It is very true that he can really seem unlikeable and rude with how he can come to taunt and tease others, but those are simply ploys he?s developed.

As far as he?s seen, sometimes the best way for someone to confront something that?s been festering within them is for that to be constantly poked and prodded at until, finally, it becomes notable.

So, his rather jerkish mannerisms are actually more of a fa?ade than they are real. Celestine is actually a rather competent soul, mature and levelheaded. He knows what he?s doing, and he understands more about people than he?ll let on. After all, he?s been bound to the house for so long now that he ought to know how to read people considering that the house has taken into itself more than a few people who were in dire need of help. . . .

The Reason They Look As They Do: Celestine has been bound to Amaryllis by a predetermined force?the house has deemed it so. Though the manor doesn?t speak, it sort of can convey what it wants and such to the souls bound to it. . . . And, from this, Celestine has come to be bound to Amaryllis, and as such, he has taken on the appearance of her deceased brother, ?Sterling.?

He has taken on this appearance because of the impact he had on Amaryllis? life. He was the primary source of love and all positive sentiments in her life until his death, and she associates her brother with solace, protection, and love. Given the fact that she?s held onto his memory for so long by dressing and melding his memory with her personality, he still has a very strong connection to her now. Celestine appears as him due to this.

Hines-Sight Blog: The Not So Perfect Ending: Outings with Kids

Sometimes I wonder why we even bother to leave the house.

Well, I know the answer to that because if we didn?t leave the house, then we would go stir crazy and wish that we had left the house amid all the chaos.

So, we leave the house, of course!

And then our journey begins. It always starts off so promising.

The weather was beautiful. We could not have asked for a more perfect day to be outside in September.

The kids danced to live music by the Sandbox band. We met a delightful woodcarver and even learned how to make soap.

We were having good, quality family time. You know the kind of family time that could be seen on a Norman Rockwell postcard.

But then, the horrible truth comes out ? the times that make you realize the reality of parenting. And it?s no Norman Rockwell postcard.



Apparently, our daughter is a ?face-painter.?

Our son avoided stuff like that like the plague, but my daughter became obsessed. Having her face painted is all she could talk about.

But, there was a line. A long line.

We did a few other things and came back to the station, but the line was still there, and one of the artists was on a lunch break. The first time we went by the station, there were two. Now there was just one artist working hard to put fairies, butterflies or whatever on a child?s face.

By this time, we were hot, sweaty, and hungry.

We can be crazy parents, but we weren?t that crazy to wait in the line for our daughter to have paint put on her face only to discover she doesn?t like it and wants it off immediately. That has happened with a tattoo.

The 2-year-old pouting began. She sulked. She refused to walk. She fell down. She ran back to the face-painting stand, but we didn?t budge with our decision. We were too hungry to wait.



Finally, we get back to the parking lot, and we make another parental decision that really turns this story ugly.

We decide to go home for a late lunch instead of getting food from the food trucks.

My 6-year-old son, apparently, didn?t like our decision and wanted to invoke veto power.

Crying, screaming, and yelling was all we heard for our short car ride home. Our beautiful autumn outing had a not-so-perfect ending. One child was sad, and the other was sent to his room for lack of parental respect.

Whose idea was it to leave the house?

Yeah, it was mine.

But, I would like to add that the time we spent there was really great. I?m sure by next week when we go on another outing, I?ll forget how our stories usually end. We have short-term memory loss and hop right back in the car for our next family adventure.
