Texas Senate again to take up tough abortion rules
AUSTIN, Texas (AP) ? Hours before final debate began Friday on tough new abortion restrictions, demonstrators on both sides of the issue filled the Texas Capitol, opponents in orange and some carrying gynecological devices and supporters wearing blue and toting images of fetuses and Bible verses.
The circus-like atmosphere marked the culmination of weeks of protests, the most dramatic of which came June 25 in the final minutes of the last special legislative session when a Democratic filibuster and subsequent protest prevented the bill from becoming law.
The Senate's leader, Lt. Gov. David Dewhurst, is determined not to let anything ? or anyone ? derail a vote again.
"We're going to have strict enforcement. If there are any demonstrations, we are going to clear the gallery," Dewhurst said Thursday. "I hope we don't get to that point but if we do, we do. This is a democracy and we will not be interrupted from doing the people's work by an unruly mob."
House Bill 2 could shut all but five abortion clinics in Texas and would be a win long-eyed by conservatives who make abortion a key campaign issue, but the raucous debate surrounding the measure has also given Texas Democrats newfound momentum. The Republican majority is expected to ultimately pass the bill, with Democrats left to do little more than enter into the legislative record material that could help defeat it in federal court.
Senators were expected to begin debate on the bill Friday afternoon, with a vote to follow in the evening or possibly early Saturday morning.
Dozens of extra police officers guarded the gallery and patrolled the hallways.
For those who break the chamber's rules, the Texas Constitution gives Dewhurst the authority to jail them for up to 48 hours, no court necessary. Every person who enters the gallery will be issued a copy of the "rules of decorum" that stipulate there can be no demonstrations or attempts to disrupt the chamber's work.
Some arrived as early as 4:30 a.m. Friday and the crowds continued to line up throughout the morning at the security station to get in the building, some carrying folding camping chairs ? despite signs at the Capitol barring camping equipment. Abortion rights activists wore orange, with the latter dominant among the early crowd.
Among the first two in line were anti-abortion activist Johanna McCrary of Conroe and abortion rights supporter Kristi Lara of Dallas. Both came to the Capitol after the filibuster and have been in Austin for more than a week.
"This is a civil rights issue," Lara said, comparing the efforts of abortion rights activists to demonstrations during the civil rights era.
"We will not give up the rights our mothers and grandmothers fought for," said Lara, who was wearing an orange dress with a white sash that read "Vote for Women" and had a plastic speculum, a gynecological instrument, hanging from her neck.
Senate Sergeant-At-Arms Rick DeLeon said Friday that no props ? including speculums and coat hangers ? will be allowed into the Senate gallery, per decorum rules.
For Dewhurst, who lost control of the Senate to what he called an "unruly mob" during a debate two weeks ago, his political survival relies on the bill's passage. Once considered a formidable politician, Dewhurst bid goodbye to his Senate colleagues in 2011, expecting to easily win a U.S. Senate seat. But tea party favorite Ted Cruz painted him as a moderate, and now he has three challengers in the Republican primary for re-election.
Democrats successfully defeated the bill in the regular legislative session. During the first special session, the Senate didn't take up the bill until the final day. That allowed Fort Worth Sen. Wendy Davis to use a filibuster to delay a vote. When Republicans rushed to try to pass the bill in the session's final 15 minutes, angry protesters began shouting and screaming from the gallery. Dewhurst could only watch with frustration as a half-dozen state troopers tried to remove more than 450 people.
As for the GOP, the restrictions are a top priority for the Christian conservative voters who make a majority of Texas Republican voters and want abortions banned. Democrats, however, see in the protests as an opportunity that could help them break a 20-year losing streak for statewide office.
Democrats believe Republicans have overreached in trying to appease their Christian conservative base and alienated suburban women, a constituency that helped President Barack Obama win re-election. Democrats have helped organize the recent protests ? more than 5,000 people swarmed the Capitol last week ? and top lawmakers have toured the state as part of Planned Parenthood's Stand With Texas Women campaign to raise awareness about the new law.
The measures under consideration Friday mirror restrictions passed in Mississippi, Ohio, Oklahoma, Alabama, Kansas, Wisconsin and Arizona, but passing them in the nation's second-most populous state would be a major victory for the anti-abortion movement.
The Texas bill would require doctors to have admitting privileges at nearby hospitals, allow abortions only in surgical centers, limit where and when women may take abortion-inducing pills and ban abortions after 20 weeks. Only five out of 42 existing abortion clinics meet the requirements to be a surgical center, and clinic owners say they can't afford to upgrade or relocate.
Republicans insist the restrictions would guarantee better health care for women and fetuses. But critics see it as a way of regulating all Texas abortion clinics out of business.
The one thing both sides can agree on is that abortion rights groups will file a federal lawsuit as soon as Republican Gov. Rick Perry signs the bill into law. Judges elsewhere have stopped enforcement of similar laws while they work their way to the U.S. Supreme Court.

Mobile phones taxes will take a toll on consumers - SpyGhana.com
The Parliament of Ghana recently passed into law a bill that places an import tax on telephones and mobile phones. Prior to this, there was zero tax on mobile phones importation.
The law, Customs and Excise Amendment Bill 2013 seeks to impose a 20 per cent levy on mobile, cellular and satellite phones imported into the country and is expected to enable government raise an amount of GH?49.8 million to support its developmental activities for the year.
The amended Customs and Excise (Duties and Other Taxes) (Amendment) Act, 1996 (Act 512) imposes import duty on telephone and mobile phones, reduces the environmental excise tax on plastic and plastic products from 15 per cent to five per cent.
The new law therefore repeals the Tariff No 6 of the Customs and Excise (Duties and other Taxes) Act, 2012 (Act 840).
The government?s immediate purpose for this tax is to raise additional revenue for the budget-to mitigate a widening deficit. In addition it explained that the tax will protect domestic manufacturers of mobile phones and protect jobs in the sector.
Before the tax came into force, Parliament?s Finance Committee, Vice Chairman, Gabriel Kodwo Essilfie, observed that import duty on telephone sets were removed in? 2008, however this did not yield the intended results. Rather, their prices increased, hence the government?s reintroduction of the import duty.
The problem with this law however is that, government?s revenue generation; protection of local manufacturers and jobs in the sector are only a partial consideration of the overall costs and benefits of the law.
Ghana has over 25 million mobile phone subscribers, exceeding the 100% penetration rate. This figure however can be deceptive as it does not mean that all 24 million Ghanaian?s own mobile phones or subscribe to mobile phone services. There is however a phenomenon of people subscribing to more than one mobile operator service.
The mobile ecosystem is made up of mobile operators, mobile phone users, importers and retailers of mobile handsets, vendors of recharge vouchers, repairers, and dealers in accessories and so on.? At the same time, mobile telephony has opened up more possibilities and has facilitated innovation in agriculture, education, health, security and better governance.
The sector also offers opportunities to applications developers and programmers.
The contribution of the sector to the economy is significant and its potential contribution to GDP is estimated to be 2.40%.? Moreover studies by the World Bank, show that there is a direct relationship between mobile penetration and GDP. In developing countries, it has been shown that for every 10% increase in mobile penetration there is a 0.81% point increase in a country?s GDP (in developed countries this figure falls to a 0.60% contribution).
According to the Ghana Chamber of Telecommunications, the sector has created over 1.5 million jobs in the country and inflation in the telecommunications industry is 0.6 per cent, the lowest among all the key sectors in Ghana, the report indicated.
A 2010 Ghana Statistical Service report had said the telecoms industry has been a key driver of economic growth. It said the sector directly accounted for 7% of investments in Ghana, 10% of government income, and 2% of GDP.
It is however clear that without mobile phones the whole mobile ecosystem and the associated sectors cannot function. What therefore is the basis for the tax on mobile phone imports?
Every governmental policy should be weighed and balanced to avoid the costs of such a policy exceeding the benefits. The key issues to analyze here are whether the government?s assertion that the tax is to protect domestic producers or manufacturers as well as protect jobs are verifiable.
Does Ghana have mobile phone ?manufacturers?? What is the contribution of these manufacturers to GDP compared to the number of people who would be denied access to mobile phones?? What is the number of jobs that can be protected from the manufacturers compared with the number of jobs in the so-called non-manufacturing sector of the mobile phone ecosystem?
The import tax clearly goes against one of the main drivers of mobile subscription growth in Africa: low-cost handsets coupled with pre-paid services have made ownership of mobile phones affordable. Moreover mobile phones have become essential consumer goods and status symbol throughout the continent, as such; the import tax could curtail consumer?s ability to spend on handsets.
The import tax will also affect the communication ability of many Ghanaians. According to the African Mobile Observatory 2011, mobile services have become the primary means of voice communication for many of the inhabitants of Africa as the number of fixed-lines has stagnated or has not increased as mobile phones have. Hence mobile phones are the main communication tool available to many people.
By increased penetration of mobile phones, Africa is at the forefront of global Mobile Money industry, but Ghana is not yet able to develop its mobile money industry to the level of other African countries. With the import tax, efforts in that direction could be hampered.
Visa Inc. did a study recently which says 93 percent of Ghanaians are aware of the mobile money product, but not many Ghanaians seem to be using the service. The study, though fails to indicate how many Ghanaians use the service.
The import tax on mobile phones could have potential negative impacts on ICT development broadly.
ICT has been recognized as the key driver for sectors such as health, education and agriculture.? Ghana?s Ministry of Communication is cited by the Africa Mobile Observatory as stating that: ?The government of Ghana is committed to pursuing an ICT for Accelerated Development (ICT4AD) vision aimed at improving the quality of life of the people of Ghana by significantly enriching their social, economic and cultural well-being through the rapid development and modernization of the economy and society using information and communication technologies as the main engine for accelerated and sustainable economic and social development?
The imposition of import tax on mobile phones is therefore at variance with this statement and reflects a policy conflict.

Neuchatel 2013 Review: IN THE NAME OF THE SON Has The Church In Its Crosshairs
Evoking the gospels both sacred and profane (Father Tarantino, hallowed be thy name), Vincent Lannoo's In the Name of the Son (Au nom du fils) is divided into six 'books'. It is only fitting for a film that veers wildly between farce and tragedy, but also between engaging thriller and limp noodle.?
It's a savage and incendiary take down of the Catholic Church that is, somewhat improbably, soft as a whisper -- a valentine to forgiveness and spirituality. As a follow up to his deadpan mockumentary Vampires, I don't think anybody could have seen this one coming.
The film opens with a YouTube prologue, where two burly and buffoonish priests make a series of increasingly ridiculous requests of their parish -- Money? Time? 500 pounds of cement, gravel and roofing materials? Of course you should volunteer it, this is The Church we're talking about! -- and Lannoo appears to be laying his cards on the table. That one priest will be later revealed as a pedophile and the other a violent militant is not the subversive ace Lannoo has up his sleeve. Instead, it's his insinuation that maybe, despite all else, they aren't so wholly irredeemable.
Neither of the two priests are the film's protagonist; that would be the devout and pious Elisabeth (Astrid Whettnall). Prim housewife, mother of two, Christian talk radio host, Elisabeth is a model true believer. So much so that she clings to her faith when her life starts being beset by a series of Job-like catastrophes. Just how Job-like? Let's make this brief. Her husband accidentally shoots himself; her church lies about how he died. Her priest molests her 14-year-old son; her son reveals it live on air. Her son thinks he might be gay; her response is to condemn him. Her son puts his chin over a rifle and pulls the trigger; she opens the door just in time to see it. This all happens in the first 20 minutes. Did I mention it's a comedy?
While the poster and preview (embedded below, though heads up -- it's only in French) play up the film as an avenging angel crusade, this is not Death Wish For Jesus. The tone it strikes is more wryly perverse, depicting its sordid goings on through a veil of absurdist irony, similar to Ben Wheatley's Sightseers and Todd Solondz's everything. In fact, it's helpful to look at the film as a kind of Solondz offering for the Sunday school set.?
Lannoo is never afraid to let his characters perform heinous acts, but at the same time refuses to let them be entirely defined by those actions. He depicts the hermetically sealed world they live in with all the requisite kitsch you'd expect, but not without warmth as well. Elisabeth's call-in radio show is ridiculously inane, but the answers she gives are well thought out and sincere. The people in her world may be sheltered and small-minded, but they're not worthy of scorn.
Except the clergy, that is.
The real problem with organized religion, the film argues, is the organization part. What sets Elisabeth down the warpath is not the events that happen to her and her family, but the cover-ups. In an extremely provocative insinuation that I wish the film had pursued a little bit further, Lannoo suggests that his character is not going to war with the Church, but rather trying to serve it. That by hunting down pedophile priests protected by the Holy See, by casting the wolves from the flock, she can cleanse the institution she loves so dearly. I don't think it's much of spoiler to say that doesn't quite happen.?
While Lannoo may condemn the institution, he doesn't disparage its teachings. Father Achille, the priest who initiates the relationship with Elisabeth's son, also teaches him lessons of value. After his father's death, Jean starts careening towards xenophobic skinhead nationalism, and it's Achille who sits him down and gets him out of it. Achille is still a pedophile, protected by a corrupt hierarchy, but that doesn't make his wise words about tolerance any less true, just all the more disturbing when the camera pans down and his hand is on Jean's.
The executions evince this same murkiness, and it is much to the detriment of the film. The violent second act is a lot slower and even-handed than what marketing materials show, with many characters giving monologues, and many kills happening just off screen -- couldn't get enough squibs, maybe? -- to the extent that I'm not quite sure how much fun I actually had with the film. Don't get me wrong; it gives you a lot to chew on. Here at the Neuch?tel film fest, I've seen people get into hours-long conversations about the film. But it almost plays better in reflection, in conversation, than it does on screen.
I suppose it's a fool's errand to criticize a film that gets you talking, gets you thinking, but there's something peculiar about this one. It's odd for an 80-minute film to feel overstuffed, but there you have it. It's to be expected. The Church is a maddening, overripe subject. As an outlet for a lifetime of mixed feeling about it, In the Name of the Son is Vincent Lannoo's exorcism.
